(hereinafter referred to as the “Client”)

Subject of the Agreement

The Service Provider agrees to create a professional presentation website for the Client based on the StartupSites package. The purpose of the service is to create a fast, modern, and mobile-friendly online presence for the Client’s business activities.

Ordered Service

The Service Provider will create a professional, one-page WordPress-based presentation website for the Client. The service includes the Elementor-based design and development, ensuring a responsive layout, as well as the design of the website’s user interface and user experience (UI/UX).

As part of the project, the Service Provider may use AI-assisted content creation and will provide the processing and integration of up to 5 images. The project includes the preparation of basic SEO settings, SSL configuration, basic security settings, and the technical preparation required to meet GDPR requirements.

The exact details, limitations, and any additional options of the project are specified in the StartupSites General Terms and Conditions and Project Guidelines.

Project Fee and Additional Costs

The total fee for this service is EUR 99 as a one-time payment, which represents the fee for the basic package provided by the Service Provider.

The start of the project is subject to the approval of the project, receipt of the service fee in the Service Provider’s bank account, and the Client’s digital acceptance of this Agreement.

The Client acknowledges that domain registration, hosting services, premium software, licensed tools, as well as custom developments beyond the scope of the basic package, are not included in the basic service fee. These services may be provided upon separate consultation and for an additional fee.

The Service Provider will commence the project according to the conditions specified in this Agreement.

Project Start and Completion Timeframe

The Service Provider will begin the creation of the project after the acceptance of this Agreement and once all project materials required for completion have been provided.

The estimated completion time of the project is 7 business days, starting from the first business day following the fulfilment of all the above conditions.

The Client acknowledges that missing information, delayed delivery of the required materials, as well as delays in providing feedback from the Client’s side may result in an extension of the completion deadline.

Information and Materials Provided by the Client

The Client agrees to provide the Service Provider with all available information and materials necessary for the completion of the project. These may include, in particular, information related to the Client’s business activities, the logo, images, text content, contact details, as well as any other relevant materials required for creating the website.

The Client is responsible for ensuring that they have the necessary rights and permissions to use the texts, images, graphic elements, trademarks, and other content provided by them, and that their use does not infringe the rights of any third party.

Design and Content

The Service Provider is responsible for creating the overall structure, visual design, user interface, user experience (UI/UX), and technical implementation of the website.

During the project, the Client may provide brand colours related to their business activities, a logo, visual or content preferences, as well as any business information that helps ensure the appropriate development of the website.

The goal of the final design is to create a professional, user-friendly website optimized for visitor experience and effective contact generation from potential customers.

AI-Assisted Content

The Client acknowledges that, during the provision of the service, the Service Provider may use tools based on artificial intelligence (AI), including but not limited to content creation, editing, translation, and linguistic and structural optimization of content. AI-assisted content will always be reviewed and, where necessary, modified before the website is published.

Images and External Resources

The Client acknowledges that images, icons, graphic elements, and other visual resources used during the creation of the website may originate from licensed content libraries, integrated tools within WordPress themes and plugins, stock content providers, as well as AI-based content creation tools. The Service Provider uses only resources whose use is permitted in accordance with the applicable licences and terms of use.

Review and Approval

Before the delivery of the website, the Client is entitled to review the completed website and request reasonable and justified modifications within the scope of the ordered service.

The Service Provider will complete the requested modifications in accordance with the original scope of the project. Requests that go beyond the scope of the original service, including new features, significant content expansions, or other requirements not included in the agreement, may be fulfilled based on separate consultation and for an additional fee.

Ownership and Access

Following the successful completion of the project and full payment of the service fee, the Client will receive WordPress administrator access to the website and will be entitled to use and manage the website as intended.

At the Client’s request, the Service Provider may retain additional administrator access for the purpose of providing future maintenance, support, or further development services. The decision to maintain such access shall in all cases be made exclusively by the Client.

Maintenance and Additional Services

Following the delivery of the website, updates, backups, ongoing operation, and general maintenance of the website shall be the responsibility of the Client.

If requested by the Client, the Service Provider may provide maintenance, technical support, or further development services based on a separate agreement. Such services are not included in the basic package and must always be ordered through separate consultation.

Limitation of Liability

The Service Provider delivers the service with professional care and in accordance with current best practices; however, the Service Provider does not guarantee the future traffic of the website, its ranking in search engines, business or sales results, or any other commercial performance.

The Client acknowledges that the success of the website is influenced by numerous factors beyond the Service Provider’s control. Therefore, the purpose of the service is to create a professional, secure, and technically well-founded website.

Prohibited Content

The Service Provider reserves the right to refuse or terminate the completion of projects that contain or support illegal, fraudulent, copyright-infringing, malicious, or any other content that violates applicable laws and regulations.

The Client declares that the content provided by them and the purpose of the planned website comply with applicable laws and do not infringe the rights of any third parties.

Data Processing

The processing of the Client’s personal data is carried out in accordance with the StartupSites Privacy Notice currently in effect. By accepting this Agreement, the Client declares that they have reviewed the Privacy Notice, acknowledged its content, and accepted the data processing conditions set out therein.
